Terms of Service

By creating an account, accessing, or uploading content to PixGB you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy (together, the “Agreement”). If you do not agree, do not use the service.
1. Who we are

2. Eligibility and accounts
You must be at least 18 years old to create an account. You must provide accurate registration details, keep credentials secure, and accept responsibility for activity under your account. One person or organisation should not create accounts solely to evade bans, limits, or enforcement.
We may refuse registration, require verification, suspend, or terminate accounts that violate this Agreement or create risk to the service or others.
3. The service
PixGB lets you upload and host image files. We store masters in their original form (without recompressing or downscaling the original file). Gallery thumbnails are generated as separate files and do not replace originals. Features, limits, and availability may change. We do not guarantee uninterrupted uptime, specific performance, or permanent storage beyond what your plan and these Terms provide.
4. Your content and licence
You retain ownership of content you upload. You grant PixGB a worldwide, non-exclusive licence to host, store, transmit, reproduce (technically), and display that content solely to operate and secure the service — including public gallery and profile display for non-private uploads, and serving direct/embed links you create.
You represent and warrant that you have all rights needed to upload and share the content, that it does not violate the AUP or any law, and that it does not infringe others’ rights. Public uploads may be viewed, linked, and indexed by third parties; treat public mode accordingly.
5. Private uploads
Private uploads are not listed in the public gallery or public profiles. Direct originals for private images are only served to the authenticated owner. Private mode is not encryption, legal privilege, or a guarantee against disclosure if required by law, if your account is compromised, or if you share credentials or links improperly.
6. Plans, limits, and payment
Free and paid plans have different storage, file-count, bandwidth, and feature limits. Limits may be enforced technically (upload refusal) or by later remediation. Paid subscriptions are billed through Stripe; taxes may apply. Fees are generally non-refundable except where UK consumer law requires otherwise. We may change plan pricing or limits with notice on the site; continued paid use after the change constitutes acceptance for future billing periods.
If a subscription lapses or payment fails, your account may revert to Free limits. Content exceeding Free limits may become read-only or subject to deletion after notice where practicable.
7. API and automation
If you use an API token, you must keep it secret, use it only for your account, and not exceed rate or plan limits. We may revoke tokens that are abused or leaked.
8. Illegal content, CSAM, and cooperation with authorities
You must not upload illegal content. In particular, child sexual abuse material and sexual content involving minors is strictly forbidden. We will report all child sexual abuse material and related account evidence to the appropriate authorities and cooperate with lawful requests. See the Acceptable Use Policy.
9. Moderation, removal, and notices
We may remove or disable content, restrict features, or ban accounts for AUP breaches, legal risk, abuse reports, or valid notices. Copyright complaints should follow our DMCA / notice-and-takedown process. We may preserve logs and content copies as needed for investigations and legal compliance.
10. Third-party links and embeds
If others embed or hotlink your images, their sites are outside our control. You are responsible for how you share URLs.
11. Disclaimers
The service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or that content will never be lost.
12. Liability
To the fullest extent permitted by UK law, PixGB is not liable for indirect, incidental, special, consequential, or punitive loss, or loss of profits, data, or goodwill. Our aggregate liability arising out of the service is limited to the greater of (a) amounts you paid us for the service in the 12 months before the claim, or (b) £50. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law.
13. Indemnity
You will indemnify and hold harmless PixGB and its operators from claims, damages, and costs (including reasonable legal fees) arising from your content, your use of the service, or your breach of this Agreement, except to the extent caused by our wilful misconduct.
14. Termination
You may stop using the service at any time. We may suspend or terminate access immediately for Agreement breaches or legal risk. On termination we may delete your content after a short operational period, subject to legal retention needs.
15. Changes
We may update these Terms by posting a revised version with a new “Last updated” date. Material changes will be highlighted on the site where practical. Continued use after the effective date constitutes acceptance.
16. Governing law
These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, without prejudice to mandatory consumer protections that apply in your country of residence.
